Consultation delivers negative orchestrated feedback on ISDS

The Commission commits itself to improve four most controversial ISDS areas, including protection of the right to regulate

The European Commission’s report to be released next week on the result of the public consultation on the controversial investor-state dispute settlement (ISDS) mechanism in the Transatlantic Trade and Investment Partnership (TTIP) agreement confirms rumours that have been making the rounds in Brussels that the vast majority of the 150,000-odd contributions submitted between 27 March and 13 July 2014 were based on a template. Areas to improve

On the basis of the consultation’s results, the Commission identified “four areas where further improvements should be explored”: the protection of the right to regulate; the establishment and functioning of arbitral tribunals; the relationship between ISDS arbitration and domestic remedies; and the review of ISDS decisions for legal correctness through an appellate mechanism. It also reiterated its intention to “further consult”on the ISDS' “core issues” with a view to developing “concrete proposals for the TTIP talks”.
